General Terms and Conditions of Use

1. Scope: Use of the private car park at Borowego 43, Krakow.
    By entering/parking, these terms and conditions are accepted.
2. Parking fees: Use subject to a fee; payment exclusively to ARALIYA;
    video data is used to ensure correct payment; no refunds for fees already paid.
3. Permitted use: Cars only; no right to a specific parking space;
    no long-term parking/commercial use only with consent. 

4. Disclaimer: Car park is unguarded; no liability for damage/loss/theft;
    liability only in cases of intent/gross negligence; vehicles must be secured.
5.Conduct: Road Traffic Regulations apply; park only in marked areas;
    keep entrances/exits and emergency routes clear; avoid or report contamination/damage.
6. Video surveillance (GDPR/RODO):
    Responsible party AraliyaSp. z o.o., Borowego 18/6, 30-215 Kraków, parking@araliya.eu;
    Purpose: security, prevention/investigation of criminal offences, enforcement of conditions
    (Art. 6(1)(f)); disclosure only to authorised bodies; limited storage period;
    rights pursuant to Art. 15 ff. GDPR/RODO.
7. Contractual penalty: In the event of violations (in particular non-payment,
    unauthorised vehicles, blocking, unauthorised long-term parking)    
    PLN 500/day; further claims remain unaffected.
8. Towing: Illegally parked vehicles may be towed at the expense/risk of the owner.
9. Miscellaneous: The operator may adjust the terms and conditions;
    place of jurisdiction is Krakow, Poland.

 

1. Scope of Application

These Terms of Use apply to the use of the private parking lot in Kraków, Borowego 43 / P1–P4. By entering or parking a vehicle on the premises, the user (vehicle owner/driver) acknowledges and accepts these terms.

2. Parking Fees

Use of the parking lot is subject to a fee.

Payment must be made to the operator. The user is required to pay the parking fee before leaving the vehicle. A valid “blue parking permission” must be visibly displayed inside the vehicle. Video data will be used to verify the correct parking time and for billing purposes. Fees already paid are non-refundable.

3. Permitted Use

The parking lot may only be used by passenger cars (PKW). There is no entitlement to a specific parking space. Parking of trailers, motorcycles, trucks, or other vehicle types is prohibited. Long-term parking or commercial use requires prior approval from the operator.

4. Disclaimer of Liability

The parking lot is not guarded. The operator assumes no liability for damage, loss, or theft of vehicles, their accessories, or other items. Liability for property or personal damage – including that caused by third parties – is excluded unless it results from intentional or grossly negligent conduct by the operator. The user is obliged to properly lock the vehicle and secure it against rolling away.

5. Conduct on the Parking Lot

The traffic regulations (StVO) apply accordingly. Vehicles may only be parked in the marked spaces. Entrances, exits, and emergency routes must be kept clear at all times. Pollution, littering, or damage must be avoided or immediately reported to the operator.

6. Video Surveillance (GDPR/RODO)

The parking lot is under video surveillance. The data controller is the parking lot operator (Araliya Sp. z o.o., Borowego 18 / 6, 30-215 Kraków, parking(at)araliya.eu).

The purpose of the surveillance is the protection of legitimate interests pursuant to Art. 6(1)(f) GDPR/RODO: safeguarding the property, preventing and investigating criminal acts, and enforcing these Terms of Use. The recordings are processed exclusively for the aforementioned purposes and will only be shared with authorized parties (e.g. police, courts, insurance companies) if legally permitted or required. The retention period is limited to what is necessary. Data subjects have rights under Articles 15 et seq. GDPR/RODO (access, deletion, restriction of processing, objection).

7. Contractual Penalty

In the event of violations of these Terms of Use, particularly non-payment of parking fees, parking of unauthorized vehicles, blocking of areas, entrances, or exits, or unauthorized long-term parking, a contractual penalty of 500 PLN per day shall apply. The operator reserves the right to claim further damages.

8. Towing

Vehicles parked in violation of these Terms of Use may be towed at the owner’s expense and risk.

9. Charging Station

The agreed contractual terms for charging stations apply. Prices and conditions are subject to change.

10. Miscellaneous

The operator reserves the right to amend these Terms at any time. The place of jurisdiction is Kraków, Poland.
